Transported Cooled Semen Agreement

 

This contract is entered into by ________________________________ herein after referred to as Mare Owner, and Diamond Six Farm, herein after referred to as Stallion Owner for one service to the Stallion, ARedHotNBlazingCheer, AQHA# 4708951 for the Mare ____________________________ Reg.No _________________

for the 2012 Breeding Season.  Stallion will be standing the 2012 breeding season at Raimonde Farms, owned and managed by Brian Raimonde, herein after referred to as Stallion Manager.

 

The Mare Owner agrees to:

1.  Pay a non-refundable booking fee of $250.00, which will reserve a breeding for the 2012      Breeding Season to the Stallion, upon the execution of this contract.

2.  Provide Stallion Owner with a copy of mare=s registration papers, front and back, at the time this contract is signed.

3.  Pay to Stallion Owner, the Breeding fee of $1000.00, Shipped Semen $250.00, less the $250.00 booking fee, prior to the first shipment.

4.  Pay a $300.00 refundable Equitainer deposit to the Stallion Manager prior to the first shipment unless a disposable container is desired, the cost of which is included in the shipping fee.  The deposit on the Equitainer will be refunded when the container is returned in an acceptable condition to Stallion Manager within five (5) days of shipment arrival.

5.  Notify both the Stallion Owner and the Stallion Manager at the beginning of the mare=s cycle for which semen will be ordered.

6.  Each collection and standard FedEx overnight delivery is $250.00.  FedEx Saturday Delivery (where available) and Counter to Counter, are additional, billed at actual cost and payable directly to Stallion Owner.  The Breeding season is from February 1 to July 1, no semen will be shipped prior to Feb. 1^st.  Collection days are Monday through Saturday, pending stallion=s collection schedule.  Stallion Manager and Stallion Owner must be notified by 6:00 PM Eastern time on the evening before semen is to be shipped.  Cancellations must be received by 9:00AM Eastern time the day the semen was to be shipped.  Priority for semen is 1. On-farm mares        2. Mares needing the first shipment in a cycle 3. Mares needing a second shipment in the same cycle.

7.  Have the insemination done at a qualified breeding facility or under the supervision of a veterinarian.  If, for any reason the mare does not settle, Mare Owner will hold Stallion Owner and Stallion Manager harmless.

8.  Return the Equitainer shipping container within 5 days to Stallion Manager by fastest courier (FedEx, UPS, etc.) at the Mare Owner=s expense.  Disposable containers do not need to be returned. 

                  

 

The Stallion Owner agrees to:

 

1. Honor a Live Foal Guarantee.  If Mare does not settle during the present Breeding Season, if she     aborts or should the foal not stand and nurse, the Mare Owner will be entitled to a return service to the same mare or a substitute (with prior approval from Stallion Owner) for the following Breeding Season  only.  As part of the Live Foal Guarantee, Mare Owner is required to provide reasonable and customary care to mare to include Killed Rhino vaccines given at 5, 7, and 9 months gestation.  A veterinarian=s statement must be provided and Stallion Owner must be notified within seven days from date of foaling        if foal does not stand and nurse or if Mare aborts.

2.  Provide a breeder=s certificate to Mare Owner, for the foal conceived from this mating, following notification from Mare Owner of a live foal.

3. Offer a re-breed if Mare dies or becomes unfit to breed; the Mare Owner shall be permitted to breed        a substitute mare to the Stallion provided the Stallion Owner has given advance approval of substitute   mare.  No refunds shall be permitted.  In the event of Stallion=s death, sale or unfitness for breeding     prior to Mare being vet-checked in foal at 16 days post insemination, the Breeding fee will be refunded       but the booking fee will, at all times, be retained by the Stallion Owner.

4.  This contract is non-assignable and non-transferable.

5. This contract is entered into in the State of Ohio and will be interpreted and enforced under the laws       of Ohio.

6. This contract contains the entire agreement between parties with respect to its subject matter. All        prior promises or agreements (either written or verbal) between Mare Owner, Stallion Owner and/or  Stallion Manager shall be void unless contained in this agreement.  Any additions or changes must be       in writing and signed by both Mare Owner and Stallion Owner.
